Rocket Campaigns General Terms and Conditions

Introduction

Together with our partners and your favourite brands, we create campaigns in which we distribute beauty and perfume samples (“Samples”) from our brand partners (“Sampling Campaign”). Rocket Campaigns offers you the opportunity to request Samples from your favourite brands. On this page we inform you of the conditions under which we will provide Samples to you. In these General Terms and Conditions, ‘we/our’ refers to Rocket Campaigns B.V. (“Rocket Campaigns”).

Please read these General Terms and Conditions carefully before signing up with Rocket Campaigns. By doing so, you agree to be bound by these General Terms and Conditions. Please understand that if you do not wish to accept these General Terms and Conditions, you cannot request a Sample. Information about us and you
1. Rocket Campaigns B.V. is a company registered in the Netherlands with the Chamber of Commerce number: 81276400. Our office is located at Joop Geesinkweg 201, 1114 AB, Amsterdam. Rocket Campaigns is part of the Parfumado Group, which is also comprised of affiliated companies Parfumado Holding B.V. and Parfumado B.V.
2. Our website (https://www.rocketcampaigns.com/) is intended solely for use by people residing in the countries specified in the relevant Sampling Campaign or Panel terms and conditions. We do not accept requests for Samples from persons located outside these countries.
3. By requesting a Sample from Rocket Campaigns, you guarantee that you are authorised to enter into contracts, are at least 18 years old (or have obtained the consent of your parents or guardians before entering into the contract) and reside in the country addressed by the respective Sampling Campaign.
Panel
1. If you are interested in receiving Samples, you can sign up for the Rocket Campaigns Panel (“Panel”). To sign up for the Panel, you need to share your name and contact details and/or complete an extensive beauty and perfume quiz.
2. When requesting a specific Sample, you can also indicate whether you would like to be contacted for future Sampling Campaigns. If you give your consent, you will also be included in our Panel.
3. If we are running a Sampling Campaign together with our brand partner and you are part of the target group our brand partner is trying to reach, you may receive an email from us asking if you would like to receive a Sample from the relevant brand.
Sample request
1. If you are interested in receiving a specific Sample, you can request one through:
  1. the form provided for this purpose by Rocket Campaigns, Parfumado or the respective brand partner, as applicable;
  2. the link in the email that you receive from us as a member of our Panel.
2. When requesting your Sample, please provide your name, email address and address. We may also ask you about your personal preferences regarding beauty and perfume when you fill in the request form for a specific Sample. By filling in this information with a Sample request, you confirm that this information is up to date and that you agree with these General Terms and Conditions.
3. We only allow one (1) Sample to be claimed per person per campaign. Where necessary, we may apply a limit of one (1) Sample per household per campaign. If you register, you guarantee that the email address you are using is your own and that you have created this email address in the normal course of business. The use of multiple email addresses to request multiple Samples is not permitted. By requesting multiple Samples you deprive others of the opportunity to request a Sample, thus damaging the success of the campaign for both our brand partner and Rocket Campaigns. If this is the case or appears to be the case, we reserve the right not to send you the Sample and not to approach you for Samples in the future.
4. Samples are intended for personal use only. Use for commercial purposes is prohibited.
Reviews and surveys
1. When you request a Sample, we may ask you to complete a post-Sample survey about your experiences with the respective Sample. We use the data from this post-Sample survey in a general, anonymous form to inform (potential) brand partners about the outcome of the Sampling Campaign and our services.
2. If you request a Sample, we may also ask you to write a review about your experiences with the Sample in question. Brand partners may share your review on their website and/or social media. If a campaign is involved, we will inform you of this before you leave your review.. We may ask you to choose a nickname, which may be published when the review is published.
3. Your review should be accurate, sincere and truthful and include the pros and cons of a product and how it works. Parfumado and our brand partners want your honest opinion in order to improve products. We would like to ask you to keep the following requirements in mind when writing your review:
  1. it is understandable and contains correct punctuation marks, capital letters, etc.
  2. is written in Dutch or English
  3. is not intentionally insulting and does not include obscene, defamatory, discriminatory, or otherwise misleading information
  4. does not contain any personal information, such as email addresses or telephone numbers
  5. contains no advertising or information about pricing or purchase locations
  6. contains no questions or remarks (for this we kindly refer you to our Customer Happiness team).
4. The review is an original piece of work written by you personally, which you have not copied from someone else. Please note that any spelling and/or grammatical errors will not always be corrected before your review is published, although we and our brand partners do have the right to correct them. Also, we and our brand partners have the right to make limited technical changes to correct potentially inaccurate, misleading or offensive information. The underlying opinion of your review will not be changed.
5. You can only submit one (1) review per product. You may also only submit reviews for products received by you. We collect your email and IP address when you submit the review so we, alongside third parties that we work with, can verify the authenticity of your review and protect against fake reviews.
6. You grant us permission to distribute your review together with any information you have shared when submitting your review. This information will be distributed to our brand partners and third party service providers who we may engage to help us collect, verify and share your review.
7. You give consent to the publication of your review by Parfumado, our brand partners and other applicable third parties.
8. Circumstances may arise that prevent us or our brand partners from publishing your review. Neither we nor our brand partners are obligated to publish a submitted review.
Delivery
1. Nothing in these General Terms and Conditions shall be construed to create any form of legal obligation for us to provide Samples to you. By agreeing to these General Terms and Conditions, you acknowledge that receiving free Samples is a benefit that you receive from us. In other words, it is a service for which you have paid nothing and which we are not contractually obliged to provide.
2. Sometimes we may be unable to deliver the Sample you would like to claim. For example, we may run out of Samples, or you do not fit the profile of the consumer that our brand partner is trying to reach. Whatever the reason, we are not obliged to explain why we will not deliver the Sample.
3. We will deliver your Sample to the address you provided when requesting the Sample. We will do our best to deliver the Sample within seven (7) business days after the Sample has been requested.
4. If you have not received a Sample within fourteen (14) business days after the confirmation of your request, please contact Customer Happiness (contact@rocketcampaigns.com) as soon as possible and at the latest within thirty (30) business days, so that we can find out what went wrong.
5. Delivery times may be longer around public holidays.
6. Samples cannot be returned.
Liability
1. If you have received a Sample of a beauty product or perfume, you cannot derive any rights from it other than that it is an indication of the nature of the product.
2. You may only use the products for their intended purpose. Instructions on the packaging and any accompanying information must be followed. No liability is assumed for any deviations in use.
3. The Samples we distribute are supplied by the brand partners. We are not responsible or liable for the content of the campaigns we facilitate or the Samples we distribute, unless otherwise indicated. If you have a problem with the content, nature or quality of the Samples or the campaign, you should contact our brand partner.
4. The delivery periods stated above are indicative and, if exceeded, do not entitle you to claim compensation. We are also not liable for any delays or losses caused by the mail delivery provider.
5. If it is established that we are liable for any damage, we shall only be liable for direct damage arising from or in connection with the execution of a contract. We are only liable for damages you incur insofar as they are caused by intent or deliberate recklessness on our part and up to a maximum of the value of the smallest size retail format of the product of the respective Sample. Any liability on our part expires in full 12 months after the date the damage occurred.
Complaints procedure
1. Upon receipt, you should check the delivered Sample for any defects as soon as possible. In the event of a defective Sample or a missing Sample, you should file a complaint, including photo or video material as proof, as soon as possible and no later than fourteen (14) days after receipt of the product, with Customer Happiness (contact@rocketcampaigns.com).
2. We will try to process your complaint as quickly as possible. If we do not expect to be able to process your complaint within a week, we will send you confirmation of the complaint and let you know when we expect to receive a substantive response.
3. If the complaint period has expired, we will no longer handle your complaint.
Intellectual property
1. Texts, pictures, website, mailings and other materials developed by us or our brand partners or under our control are protected by copyright, trademark, design right or other intellectual property right.
2. You may not in any way reproduce, modify, copy, distribute or use the materials for commercial purposes. For your own use, you must comply with all our intellectual property rights.
3. We have the right to quote and share on our websites and social media images and texts posted by people who have registered with Rocket Campaigns or otherwise shown an interest in our Samples and services on a website, blog or social media.
Amendments and disputes
1. If, after the agreement has been concluded, it turns out that it is necessary to amend or supplement the contents of the agreement in order to execute it, we will, in consultation with you, amend the agreement accordingly in good time.
2. These General Terms and Conditions apply to all agreements, deliveries, orders, promotions and Sampling Campaigns carried out by us or on our behalf.
3. We reserve the right to amend these General Terms and Conditions at any time.
4. A provision that proves to be void or voidable shall in that case be replaced by a provision that comes closest to what we had in mind when drawing up these General Terms and Conditions. If this situation occurs, it will not affect the other provisions of these General Terms and Conditions.
5. All agreements are governed exclusively by Dutch law.
6. In the event of a dispute, the court in Amsterdam shall have jurisdiction.
